The Answer: As of January 1, 2026, Texas Law (SB 1968) requires all licensed agents to have a signed written representation agreement in place before showing a residential property. This is designed to protect you by ensuring you have a clear understanding of who is representing your interests, what services are being provided, and how your agent is looking out for your legal and financial safety during the tour and beyond.
The Answer: In the current market, compensation is fully negotiable and is not set by law. While the representation agreement defines the professional fee for my services, that fee is often covered by the seller as a "Buyer's Agency Contribution" or negotiated into the final purchase offer. The majority of the time the Listing Agent Brokerage pays a percentage of their negotiated fee to the Buyer's Agent for bring the Buyer. You will never enter into a Contract without knowing whether the Seller is covering all or part of the fee.
The Answer: No. There is no "standard" or "fixed" commission in the state of Texas. All professional fees are negotiable between the broker and the client. We discuss our fee structure openly during our initial strategy session based on the level of service, niche expertise (such as Probate or Farm & Ranch), and the complexity of the transaction.
The Answer: While you can contact a listing agent directly, it is important to remember that their primary legal and fiduciary duty is to the seller. Their job is to get the seller the highest price and best terms. You would be a Un-Represented Buyer responsible for all your actions. The Listing Agent can only public listing facts and can not give advice or opinions to you. By having your own Buyer’s Agent, you have a dedicated advocate whose sole mission is to protect your equity, negotiate your repairs, and ensure you don’t overpay for the property.
The Answer: Our representation agreement is a commitment to work together toward your goal of homeownership. If your plans change and you decide not to purchase a property, you are not penalized. The agreement simply ensures that if you move forward with a purchase during the term of our partnership, you have professional, licensed protection throughout the process.
