Buyer Agent Representation Overview

  • In Texas, by default, all Agents represent the Seller through a listing agreement, or by "Sub-Agency"

  • Without written agreement between you and and Agent, an Agent can not "advise" you as a Client.

  • Typically, Buyers do not "pay" a commission, they are paid a split off the Listing Agent's commission. 

  • Can I represent myself in a transaction. The short answer is Yes - BUT - With all the disclosures & legal parts of a contract - It is not advisable.

  • I don't want to be "tied down" to only one agent. Then ask for a limited written rep agreement based on location or time.

  • Can the same office represent me and the seller? Yes, through a special Intermediary status, the Broker assigns an Agent to each party to represent them.
