How Do Water Rights and Canal Water Districts Affect a Land Sale in Hidalgo County?

In the Rio Grande Valley, the value of a ranch or farm is often tied directly to its water rights. With over 30 years of local experience, I understand the complexities of various Irrigation Districts and how to verify if "water follows the land." Many parcels of land are paying for water and wonder what they are paying for to the Irrigation Districts? The Irrigation Districts manage the canal system that carries the water from the Rio Grand River to the Owner's property. This distribution is what you are paying for. Whether you are selling irrigated farmland or a recreational ranch, I ensure that all water allocations are properly documented and leveraged to maximize your property's market value.

Can I Maintain My Ag-Exemption (1-d-1) During The Sale of my Ranch or Farm?

Maintaining an Agricultural Appraisal (Ag-Exemption) is critical to preventing a "rollback tax" for the Seller. Because I have been a lifelong resident and active in the RGV real estate market since 1994, I guide sellers through the necessary disclosures and qualifications required by the Hidalgo or Cameron County Appraisal Districts. This expertise protects you also through my use of State of Texas Promulgated Contracts, that have language in them that states HOW a Sale or Change Of Use "triggers" Roll Back Taxes. Using any other Contracts MAY or MAY NOT have this specific language in the Contract. It makes sense to use my Services and Experience to help you in the marketing, negotiating, and closing of your Farm or Ranch property.

What Is The Process For Selling Land With Severed Mineral Rights in South Texas?

Many properties in the McAllen and surrounding areas have severed or reserved mineral rights. My specialized approach involves a deep dive into the property's title history to clarify what is being conveyed. Whether you own 100% of the executive rights or a fraction of the royalties, I utilize my extensive network of land professionals to ensure your Farm & Ranch listing is marketed accurately to avoid legal hurdles during the closing process.

Severed: The mineral rights are sold to a party, separating them from the surface ownership. Reserved: A previous owner sells the surface land but explicitly retains the rights to the minerals.

In South Texas, severed or reserved mineral rights mean the ownership of the underground mineral estate (oil, gas, and minerals) is separated from the surface estate (the land itself). Under Texas law, the mineral estate is dominant, meaning the owner of the severed minerals can reasonably use the surface for exploration, even without the landowner's permission
