An Emergency Checklist for

The immediate steps every executor or family member should take to stabilize a Texas estate before the legal probate process officially begins.

PRIORITY 1:

Securing the Physical Property

In South Texas, vacant properties are a high liability.
Your first duty is preservation.

1. Secure the Perimeter: Change the locks immediately. This isn't about distrust; it’s about centralizing responsibility. At this point agree on an Heir or the future acting executor to control access.
(Keep in mind the responsibility if anything is missing later)

2. The Environmental Check: Adjust the AC to prevent mold (critical in the RGV humidity) and clear out perishables.

3. Vehicle Check: Ensure all car keys are accounted for and vehicles are parked in a secure, locked garage or gated area.

PRIORITY 2:

Locating The Original Will

The Hidalgo County Probate Courts generally require the original wet-signature Will, not a copy, to grant Letters Testamentary.

1. Search Locations: Look for a fire-safe, a desk "hidden drawer," or a safety deposit box key.

2. Contact the Attorney: If you can’t find the original, check the decedent's records for an attorney's business card; they often keep the original in their firm's vault.

PRIORITY 3:

Vital Records and Notifications

You cannot act on behalf of the estate without proof of death.

1. Order Death Certificates: Request 10–15 certified copies through the funeral home or the Hidalgo County Vital Statistics office. You will need these for every bank account, life insurance policy, and property transfer.

2. Notify Agencies: Contact the Social Security Administration to stop payments and notify the decedent’s employer regarding life insurance or final paychecks.

PRIORITY 4:

Preventing "Estate Leakage"

Automated systems will continue to pull funds from the estate unless you intervene.

1. Forward the Mail: Visit the USPS office in McAllen, Mission, or Edinburg to forward the mail to your address. This is the only way to catch incoming bills or unknown bank statements.

2. Inventory High-Value Items: Take a video walk-through of the home. Document jewelry, art, and electronics to ensure the inventory is clear from day one.
