Before any home can be placed on the market or cleanly transferred to a qualified buyer, title underwriters require absolute, undeniable proof of ownership.

For many families—especially out-of-area executors managing properties from hundreds of miles away—gathering these records feels like an overwhelming scavenger hunt through county offices. Pockets of land or older subdivisions across Hidalgo County frequently present complex title histories, missing documentation, or unrecorded family transitions that can halt a sale in its tracks.

1. Legal Authority & Court Orders

Before a listing agreement or transfer deed can be signed in Texas, the court must officially designate who possesses the legal right to execute documents on behalf of the estate.

  • Letters Testamentary: Issued by the probate court if the deceased passed away with a valid Will. This document officially empowers the named Independent Executor to sell the real property.

  • Letters of Administration: Issued if the individual passed away intestate (without a Will). This names the court-appointed administrator.

  • Small Estate Affidavit / Affidavit of Heirship: Specialized legal tools used in specific clear-lineage situations to transfer real estate title without full-scale court administration.

2. The Official Real Property Deed

You must verify exactly how the property was last recorded in the official public records. This alerts us if the home is tied up with outdated survivorship clauses or historic family names.

  • Recorded Warranty Deed: The legal document detailing when and how the deceased originally took title to the land or structure.

  • Where to verify online: You can run an initial name search on the Hidalgo County Clerk’s Official Records Portal (hidalgo.tx.publicsearch.us).

  • What we look for: We review these files for outstanding contractor liens, historic mechanics' liens, or secondary family members named on the deed who may have passed away without a recorded death certificate.

3. County Appraisal &
Property Tax Status

Texas property taxes are paid in arrears. This means outstanding tax balances must be calculated down to the penny and prorated to the exact day of closing.

  • Hidalgo County Appraisal District (HCAD) Account Page: This verifies the legal description of the property, correct parcel dimensions, and current assessed value.

  • Where to verify online: Enter the property address into the search tool on the official HCAD Property Portal (hidalgoad.org) to view active Property IDs and structure maps.

  • Tax Assessor Statement: We check for delinquent balances or deferred "Over-65" exemptions that will trigger a mandatory rollback balance at the title company upon sale.

4. Historic Title &
Property Disclosures

Tracking down older documentation can save the estate thousands of dollars in transactional expenses and weeks of processing delays.

  • Prior Title Policy Document: If you can locate the physical title insurance policy from when the deceased originally bought the home, the existing boundary survey can often be reused—saving the estate $500 to $800 on a new surveyor fee.

  • Subdivision Deed Restrictions: Older, mature residential neighborhoods or historic sectors in McAllen may have non-mandatory HOAs or aged deed guidelines that must legally be disclosed to incoming buyers.
