If you have been named as the Executor in a loved one’s Will, you likely already know that you have a big job ahead of you. However, you might have noticed that banks, insurance companies, and title companies won't let you do anything yet.

To take action, you need Letters Testamentary. In Texas, this is the official court document that grants you the legal authority to "step into the shoes" of the deceased.

What Exactly Are Letters of Testamentary?

Despite the name, these are not "letters" you write yourself. They are official certificates issued by the Hidalgo County Clerk after a judge has approved your application.

Think of them as your "Golden Ticket"—without them, you cannot legally sign a listing agreement to sell a house or withdraw funds from an estate bank account.

The 3-Step Process in Hidalgo County of Texas

  • Filing the Application: Your attorney files the Will and an application for probate. There is a mandatory 10-day waiting period while the "Notice to the World" is posted at the courthouse.

  • The Probate Hearing: You must attend a hearing (often via Zoom in Hidalgo County) where you "prove up" the Will. The judge will then sign an order appointing you as Executor.

  • Taking the Oath: You will sign an "Oath of Office" swearing to fulfill your duties. Once filed, the Clerk issues the actual Letters.

Why You Need the "Original" Document

  • When you sell a home in McAllen or Mission, the title company will require a "Certified Copy" of your Letters that is no more than 60 days old.

  • Pro-Tip: Don't just order one. You will likely need 3–5 certified copies to provide to different financial institutions, as most will keep the copy you give them.

Independent vs. Dependent Administration

  • In your hearing, the judge will determine if you have Independent authority.

  • Independent: You can sell the home and pay bills without asking the judge for permission every time.

  • Dependent: The court must approve every single transaction, including the sale price of the real estate.
