Died Without a Will?:
The RGV Heirship Determination Roadmap

32 Years of Real Estate Experience To Use For Your Strategic Advantage.

When a resident of McAllen or Mission passes away without a valid Will, the state of Texas—not the family—decides who inherits the home and land. This legal process is known as Determination of Heirship, and it is significantly more complex than traditional probate.

The 2026 Roadmap to Clearing Title Without a Wil

Intro: When someone passes away intestate in the RGV, the legal goal is to reach a "Judgment Declaring Heirship." This court order acts as the master key to unlocking real estate and bank accounts. Below is the 4-step framework we use in Hidalgo County to move your family from legal uncertainty to a clear title.

Securing the Judgement:
The Final Court Order

A Judgment Declaring Heirship is the only document a Texas title company will accept to transfer a decedent's property.

It is the final decree from the Edinburg probate court that legally names the heirs and their ownership percentages, officially repairing the chain of title for a future sale.

The Role fothe Attorney Ad Litem

To ensure no heirs are missing, the judge will appoint an independent attorney (Ad Litem) to verify your family history.

They act as a neutral third party, protecting the court from future claims and ensuring the estate is distributed strictly according to Texas law.

Providing Disinterested Witnesses

You must bring two "disinterested" individuals to testify before the court.

These are people who knew the decedent personally—such as long-time neighbors or family friends—but who have no financial stake in the inheritance. Their testimony confirms the family tree to the judge.

Navigating Texas intestacy Laws

Without a Will, the Texas Estates Code determines the split.

Whether the property is "Community" or "Separate" makes a massive difference in how it is divided between a surviving spouse and children.

We help you understand exactly where the property stands before you head to court.
